Why It Matters in South Florida
The June 2021 collapse of Champlain Towers South in Surfside, which killed 98 people, put building safety back at the center of public attention and tightened enforcement across both counties. South Florida’s environment accelerates deterioration in ways most of the country doesn’t contend with: salt-laden air, high humidity, hurricane exposure, and chloride intrusion that corrodes reinforcing steel from the inside.
Concrete exposed to salt air and rain absorbs chlorides that reach the embedded rebar, causing it to corrode, expand, and crack the surrounding concrete from within. A Related but Separate Requirement: SB 4-D Milestone Inspections
Owners of condominium and cooperative buildings should not confuse 40-year recertification with Florida’s statewide Milestone Inspection law, SB 4-D, passed in 2022 after Surfside. The two programs are separate and can apply to the same building at different times.
SB 4-D requires condo and co-op buildings three stories or taller, statewide, to complete a milestone structural inspection by December 31 of the year they turn 30, and every 10 years after that. It also requires a Structural Integrity Reserve Study. Buildings with a certificate of occupancy issued on or before July 1, 1992, were required to complete their first milestone inspection by December 31, 2024; that deadline has passed. An earlier 25-year trigger for coastal buildings was made discretionary rather than mandatory under a 2024 amendment.
The practical distinction: SB 4-D is a statewide condo and co-op law tied to age 30. The 40-year recertification is a Miami-Dade and Broward county ordinance tied to age 40, and it applies more broadly, to commercial and other qualifying buildings, not just condos and co-ops. A condo building in Miami-Dade may owe both, on different clocks.
Which Buildings Are Subject to the 40-Year Requirement
The 40-year recertification applies broadly to:
Commercial buildings, multifamily residential buildings (condominiums, apartments), mixed-use structures, and buildings three stories or higher with multiple dwelling units, located in Miami-Dade or Broward County.
Exemptions differ by county, and owners should confirm which applies to their property rather than assume.
Miami-Dade County (Code Section 8-11(f)) exempts single-family residences, duplexes, and minor structures with an occupant load of 10 or fewer and a gross area of 2,000 square feet or less.
Broward County (Code Section 27-285) exempts single-family homes, duplexes, buildings under 3,500 square feet, and government buildings on tribal land.
Because the exemption thresholds and code citations differ between the two counties, owners near a county line or with portfolios spanning both should verify the applicable ordinance with their local building department before assuming a property is exempt.

Starting 12 to 18 months before your deadline gives you room to absorb the unexpected, whether that’s a delayed contractor bid or a repair scope that grows once concrete removal exposes what’s underneath.
Legal Framework and Oversight
The 40-year program originated in the South Florida Building Code (1979 edition), Subsection 104.9. The biggest cost drivers are square footage and unit count, the extent of concrete spalling and steel corrosion, how accessible the structural elements are, whether shoring or temporary support is needed, and the scope of waterproofing and restoration work required.
Consequences of Non-Compliance
Missing the deadline carries escalating consequences: daily fines that increase over time, revocation of the certificate of occupancy (which makes the building legally uninhabitable), forced building closure and tenant evacuation, inability to sell or refinance the property, legal exposure if a structural failure occurs in an uncertified building, and difficulty obtaining insurance or coverage exclusions.
Enforcement has tightened noticeably since Surfside. Building departments across both counties are more actively pursuing non-compliant properties than they were before 2021.
Step-by-Step Roadmap
Step 1: Determine Your Deadline
Calculate 40 years from your building’s certificate of occupancy date. This is a legal document, not the construction start date, so pull the original if you can find it in property records, local building department archives, title company files from your purchase, or condo or HOA historical records. If you can’t locate it, contact your local building department directly; they maintain records for every building in their jurisdiction.
Don’t wait for a notification letter. Buildings slip through notification systems regularly, and the responsibility for compliance sits with the owner regardless. Set a reminder for 18 months before your 40-year mark and start there.

Step 2: Hire a Licensed Professional
This is the most consequential decision in the process. Reports must be prepared by an engineer or architect qualified by training and experience to assess building structures.
